That is certainly a wtf, if only because one would expect they'd count as a weapon in most legal definitions. If I were caught with one, I highly doubt I could get out of trouble just by telling the cops it's not legally considered a weapon. A lawyer might argue them out of it in court, sure, but you don't want to arrive at that point in the first place, and until the day nobody knows wtf a flamethrower is or that it was ever used in warfare, you will most likely be stopped for hauling one around in public. You might be able to use it on a farm in Idaho even, but most sane farmers would want more easily controlled methods of controlled burning, since regardless of how you started it, you're going to catch major shit for setting the whole of the panhandle's forests on fire.
