Now the question is, who does Obama nominate? Not sure if there's a short list of possibles out there somewhere, but I'm personally hoping he just says 'fuck it' and puts up Elizabeth Warren.

Whatever. I'm glad the man is out of this job, though I'd have preferred he'd retired and gone to live on a ranch somewhere for his last years in peace. From what I knew of the man, though... He probably would have preferred to die on the bench. Literally, if he could have.

No, no, you don't understand. I mean to say that the absence of opinions written by Scalia improves the average quality of judicial writing in the United States, in the same way that filtering out dirt improves the average quality of drinking water. It's not a matter of who his replacement is - presumably that person will already have been writing legal opinions for quite some time. It's a matter of something bad not being there anymore.

As if this election year wasn't already a three-ring circus, now not only is there a vacancy on the bench, it's the place occupied by the bulwark of Conserative thought in the Supreme Court?

This election just hit Defcon 1. I bet he held on to his last breath to prevent a vacancy during Obama's term.

This election just hit Defcon 1.

Yeah, Scalia is thought of as the conservative of conservatives, so to speak. Plus the fact that there was going to be up to four potential new Supreme Court Justicises that the next president would appoint. The fact that the balance and future path of the Supreme Court is going to be decided by the next president only makes it an even bigger deal with Scalia's death.

republican debate on in 52 min ish. There probably won't be a SCOTUS related question in the debate, but who knows.
