Bill S.978 will Criminalize Gameplay Videos

That's right.  Putting any video up on youtube that contains any amount of copyrighted material could land you in prison for up to 5 years.
No more Let's Play's.  No more E3! streams.  No more Abridged series.  And probably not even your home videos because you forgot to turn off the radio (playing your favorite music station) when your cat started doing something cute.

Yeah.  If it does get passed, it'll probably get to the Supreme Court in no time flat and, if there's enough publicity, the outcry will be strong enough to get it declared unconstitutional.  Which it is.

How do they decide how much copyrighted material or public performances are worth? Especially previews and LPs.

I have no idea why they don't view LP's as free advertising. I mean people buy these games, then record videos of them playing it. Then post it on their youube channel, some people get millions of views.

I'll say what I always say regarding things like this. In a backwoods yet corporate nightmare, the Liberal Crime Squad was born...

It's a fairly simple calculation. First start with how much money could theoretically have been made by selling that particular instance of the material to each person who may theoretically have viewed it. Then, multiply it by about 10, to make sure the message takes. Use this value, or the highest amount the law will allow, whichever is lower. Or just go for the highest amount the law will allow, if you're feeling lazy.
