Because, and to reiterate your bloody good luck, he hasn't seen any of your PROBABLY HERETICAL AND DISGRACEFUL actions. :P
I mean, you're technically 'obeying orders' since you've already 'retreated' and are 'at the general area your commanding officer is in'!
At least provide supporting fire to us! I mean Guardsmen aren't known to do friendly fire with their lasguns! :D

Edit: The...the same goes for the rest of you dudes acting to shoot him. He only acts on principle and based on what he's seeing. :P Rechecking everything, y'all are basically clean unless you don't follow orders WITH PASSION AND ZEAL. Do note that the last four words do mean giant loopholes in how you do it, too.

Yeah, but if we kill the bastard, there's one less Commissar in the world, and that's always good. Unless the Commissar is Cain, Yarrick, or Gaunt. But this guy seems to be your average BLAM-happy, HERESY-shouting, dickhead Commissar.

Good point. I change my Action to:Lure A VERY big Orc into killing the commissar for me!

((Alright, um, not to intervene in what may be something people think how IC they shall act, but in this kind of setting [Warhammer 40k], the Commissar is 'known to be doing his duty' when he...shoots his own men. That's the current culture in how to keep morale or anti-heresy up in general [I mean some aren't as good as Ibram Gaunt...], but I sorely advise not to really go through with shooting the Commissar assigned to our squad. If this one is actually tainted by Chaos or such, we're not of the rank to actually figure it out yet just because he's shooting us. The consequences mean being branded traitors and being killed either way, or the GM spinning it out into another...plotline of being renegades, which...somehow I find a nice twist of creativity o_O))

Also for posterity:
Get to retreating! If I'm in not-that-far-but-not-that-close proximity to other allies but to the orks, lob a grenade! Focus on retreating, but focus also on no-friendly-fire! Try to get some shots off if I can spare it.
If I can defend that Commissar, I shall, but priority goes to any ORKS nearest to me with my lasgun.
To be fair a lot of commissars die from "enemy" fire far from the enemy and a lot die due to friendly fire "accidents" when in combat

so the people are being guardsmen only suicidally overt in their attempts. After all killing your Emperor given commissar is grounds for execution

You can shoot at the foul traitors while running away from the orks. The traitors will be in front of you while the orks will be behind you.

++Thought for the Day: You are the Emperor's Chosen. Hear His great anger in the roar of the bolt pistol. See His almighty fury in the blades of the chainsword. Feel His undying strength in the protection of your armour.++

Follow orders and retreat.
[3] vs [6] You rapidly extricate yourself from the abominable filth behind you, the green menace quickly becoming small had you the faintest inclination of looking behind you rather than focusing on your orders. Their attempts to kill you, if you could even call their mockery of marksmanship an attempt, fails utterly, the Emperor guiding your path away from the orkish bullets. You arrive safely back at your trench.

Get to retreating! If I'm in not-that-far-but-not-that-close proximity to other allies but to the orks, lob a grenade! Focus on retreating, but focus also on no-friendly-fire! Try to get some shots off if I can spare it.
[2] vs [5] [3] Though your search to punish the orks for the blasphemy of their existence further, you find no way to do so without hampering your ability to follow the order of retreat or injuring your fellow guardsmen. You are left solely with the option to make it back to your trench in one piece, successfully doing so, the only mark against you being a small amount of dirt hitting your flak vest after getting hit by an ork shoota.

Shoot the Commissar in the back of the head as he charges Lord Brassroast. Overcharge the power pack if possible. If that does not kill him, throw the lasgun at him and start praying to the Emperor as I dive into cover.
[3] vs [4] You fire a volley of lasbolts against the brave and dutiful commissar, but your failure only serves to prove that your traitorous soul no longer harbours the Emperor's favour. [1] vs [6] Your follow-up throw further proves your damnation in the eyes of the Emperor, for by his influence you trip on a rock you didn't notice before, slamming the lasgun onto the ground in your fall and detonating the charge pack as the machine spirit vents its fury against you for your betrayal against both it and the Imperium! (You are dead.)

Follow orders and retreat. Help MoonlitShadow's character in shooting the Commissar.
[1] vs [3] You join your traitorous brethren in slaying your commissar and similarly fail, the Emperor guiding the lasbolts with his divine influence away from the sanctic body of his loyal servant. [1] vs [5] The orks, doing what they can to fight off the guardsmen loyally and dutifully following the order of retreat, see your stationary position shooting at the commissar and take the opportunity to tear you apart with their dakka. (You are dead.)

Pull out my gun,  put it to my head, offer a quick prayer to the emperor, and fire... at the commissar.
[3] vs [5] You commit suicide in the general direction of the commissar. It's not an effectively thought out or executed tactic, but such is the deranged thought process of the traitor. (You are dead.) ((Huh, you changed your action. Well, let's see how that works out for you.))

[1] vs [2] Your manic shouting and screaming fails to even gain the notice of the orks on the far side of the battlefield, much less any attention or willingness to follow your suggestion. [5] vs [3] In the end, your brief dabbling in consortation with xenos is quickly ended by the teeth of the commissar's chainsword, the rotating blades splitting you from crown to pelvis in a shower of blood, bone, and flesh. (You are dead.)

Protect the Commissar
[1] vs [3] You raise your lasgun to proudly defend your regimental commissar from the traiterous filth, only for the last of his assailants to be executed by your self-appointed charge. [4] vs [5] The orks whom you are still among krump you rather cunningly while your back is turned. (You are dead.)

Do a fighting retreat, toss my grenade if friendly fire seems unlikely.

If I'm already in the trench, ignore the above and shoot orks.

[1] vs [2] [3] Seeing no opportunity to exact rightful vengeance against such a hated enemy mankind without earning vengeance by your race against you, you sprint swiftly back towards your trench and safety, but only reach halfway before an ork shoota hits you! It is a glancing blow, but with the large caliber favoured by the orks this would kill you too, were it not for your flak vest and the Imperial Infantryman's Uplifting Primer which you keep in your back pocket. [1] [6] vs [3] You quickly leaf through, hoping against hope that the single most important section of the book is undamaged as it should be and fall into despair when you see it has been damaged. The blank box which by penalty of death on failure must be kept clean and clear is not, a large hole taken out of it with gunpowder covering the rest. The commissar, passing on the way to meet with your colonel, sees the state of your Primer and delivers the Emperor's justice to you for such gross levels of incompetence. (You are dead.)

Everyone:
As you finally reach the safety of the trench (or "safety" in the case of Capto), what remains of the regiment opens fire on the straggling orks, killing or at least downing the ones in front. The rest as well as all the orks behind them are cut down and tread underfoot by the righteous fury of the Leman Russ regiment, finally arrived to end the battle taking place on the Emperor's soil. The war for KOB101 was thus won by the brave forces of the Adeptus Astartes, who used the distraction of the battle to kill the Warboss leading the orkish forces, throwing its forces into disarray, and leaving them completely defenceless for the follow-up attacks led by His brave Space Marines. Ave Imperator.

Would love a spinoff, actually :P Something as simple as this one, but also covering the details we've discussed or stuff. This was a nice little play with the dice and narrative! Personally, I'm happy with leaving the epilogue for a later game, but sure if you'd like!
