I think that if you did it first, you just have it. Because realistically, if someone brought their troops and colonized a land, someone coming 4 hours later and saying they own it doesn’t make a lot of sense.

How about when you chose to colonize you can optionally also make an attack? If neither colonize-in-force, then neither get it, otherwise it's a standard fight. Taking into account various fight modifiers as well.
