This ain't the only case on the Court's docket, and New Judge means New Docket, probably already filled with stuff because taking over Trump's case wasn't anticipated.

The independent state legislature theory has been shut down by SCOTUS in Moore v. Harper with a 6-3 opinion, affirming the power of state judiciaries to intervene in state-regulation of federal elections (e.g. voter district map drawing) via state statutory or state constitutional means because the "Elections Clause does not vest exclusive and independent authority in state legislatures to set the rules regarding federal elections."

Kavanaugh joins with the majority and has written a concurring opinion, commenting on standards of review of state law.

Thomas has written a dissenting opinion that would have the case dismissed on mootness, and support for the theory if not, based on federal supremacy and textualism(/originalism?). He is joined by Gorsuch in full, and Alito in part with respect to mootness.

Decision in question makes it a lot less likely republican malfeasance will manage to steal an election through some of the horseshit they've been trying to push through to fuck with the federal election process. I suggest Congress start moving towards using social welfare if they want to boost racial diversity. The poor, which are disproportionally racial minorities, have the hardest time making it to college. Pass it, ride it towards asymptotic equality.
