I guess my question is denying public use of an area protected under free speech?
It is being used by the public, public protestors who are exercising their rights to free speech and free assembly, which many people forget are in the same amendment.

I don't understand the constitution well enough to know if this voids other laws such as J-walking, trespassing, and loitering.

Worth remembering that pedestrians do have right of way over automobiles, and yet obstructing traffic is an offense.  Lo and behold, trying to enforce every law and every right in every possible circumstance leads to some conflicts.  In the United States at least, there is sort of a legal recognition of the fact that exercising a right to assembly on public ground often requires breaking laws like jaywalking and loitering - if enough people do it at the same time, it doesn't really count as jaywalking and loitering anymore.  On the rare occasions that peaceful assemblies are arrested (usually they're just shooed out of the way), you see any charges are usually dropped in short order.

Most cities, you do actually have to get a permit to assemble a large number of people; it's not a restriction, since you can still get one.  That's to make sure you don't hold a carnival in the middle of the street without telling anyone, and so police, fire fighters, and paramedics can know there's a large number of people they might have to respond to.

If I'm remembering the laws correctly, they actually have to give you an assembly permit if you ask for one.

Yeah, you can take them to court if you don't and the justice system looks very favorably on such cases.  They are probably only going to turn you down is if you are a dumbass who picked a dangerous location.

I'm getting ready to go to the Occupy Indy event right now, and will try to make an appearance on their livestream.  I'll make a shout out to the bay12 community if/when that happens :)  Should be within the next 1-2 hours.

Ok... that is assuming that the livestream is actually operating while I'm there... they've had a lot of technical problems :(

LordBucket: The problem isn't that it's an absolute claim, it's that being a corrupt asshole isn't actually part of being a police officer in the same way that being weak isn't part of being a woman, even though it's obviously entirely within reason for a single entity to be both and there may even be correlation between those things. I'm not attempting to enforce slavish literalism, I'm trying to correct the same sort of ridiculous categorization that lets a corrupt police officer brag about beating the shit out of some protester (because protesters, obviously, are lazy college kids who don't like the idea of doing a hard day's work).

I'd buy the explanation about validity of discussing organizations as a singular entity more if there weren't examples all over this thread of people treating "the police" and "the police department" as interchangeable - obviously, the people I'm talking to don't make that distinction.

I completely agree with your arguments, they just have nothing to do with mine.

You have been watching this thread, right? The NYPD has attacked and arrested hundreds of protestors by this point. What the hell will it take for them, as an organization, to be immoral in your eyes?

This is probably going to shock you, but I have no problem with them curtailing personal freedom as long as they aren't shooting people. The NYPD be populated by corrupt and unethical police officers, but it's not populated by murderers. Theoretically.
