Yay... more terrifying Orwellian signs from the recent flare in internet crackdowns. On Jan. 13th, the co-founder of the peer-to-peer video sharing community NinjaVideo was taken into custody, to await a 22 month prison sentence. The bad part wasn't that she was convicted; in fact, she accepted the court's charges, and pleaded guilty. Rather, her right to self-surrender was revoked, and she was prematurely detained, for trying to make her story public via Facebook.

To explain; the court's sentence originally released her from legal custody, until room opened at the detention center she was to be sent to. After posting a plea to her online community to publicize her story, however, she was deemed "likely to flee" and immediately taken back into police custody, to wait until she could begin her prison sentence... effectively preventing any further communications from her.

The grounds on which they returned her to prison were questionable at best, and violations of her constitutional rights at worst:

Copyright infringement is against the law and Ms. Beshara pled guilty. Expressing some anger that she is going to prison for her conduct is speech that is protected by the Constitution. See U.S. Const. Amend. I.

Some scary shit going down over the last few weeks. I continue to be at a loss for what to do, other than spread the word.

At least they're trying to get the proceedings out to the public... I guess?

Actually looking at the thing (though not listening, not running sound at th'mo), I have to say I find the coloration and construction of the puppets suspicious. Is it coincidence that the puppet on the stand is both of caucasian skin tone and the most human looking?

I dunno man. I dunno if anyone knows. We've officially gone into "bread and circuses" on this one. Is there even an answer?

For those of you who don't know. Jimmy Dimora is a bastard, former Cuyahoga County Commissioner, and totally corrupt son of a bitch whom the Feds are in the process of frying.... They could not have his trial in Cleveland, because everyone freaking hates him for what he did. It's worse than Lebron James. In fact they would welcome him back to show they would enjoy his company more than Dimora's and entirely out of spite, because to this day no one will stop talking about that James guy. Meh. There's a reason the FBI kicked in his door and took everything in his office for evidence.

The whole thing is just ...wow. I dunno whether to be scared or not. On the one hand we've finally found a way to get people to care about relevant local issues. On the other hand, the way is puppets.... Welp, we're boned....
In Spain and France there used to be a very popular show called Puppet News. They satirized ongoing events by using puppets of public figures. A common quip back then was that at times they seemed less of a parody that the people they were inspired in.

Also, wasn't Alito a Bush appointee? Yet he makes so many reasonable arguments I tend to agree with...

Just when I feel like I am living in a worthless distopian cesspool, there is some tiny ray of light. And that makes me angry because it shows that the system can work to fix these wrongs, but just does not most of the time.

I've said it before, and I'll say it again, the Supreme Court are the only people worth anything left in the US government. I've been paying attention to this case, and I expected this outcome, but 9-0? Even with the concurrence, that's impressive.

Actually it makes perfect sense for it to be 9-0 and not just because I agree with it/it helps me.

So basically if you want to catch a deer, you have to know how a deer operates: under what system it functions. To know how how the Supreme Court operates, you have to know under what system it functions. Most of my Supreme Court legal commentary is based not upon what I think, but rather upon how it conforms with or deviates from legal process.

Here, the Supreme Court followed precedent. The closest case was one where police placed a locator beacon of sorts  on someone's car. The reason this is allowed is because it doesn't really show the police anything they couldn't see with their own eyes. <--- This is the standard traditionally. Mere technological augmentation is not disallowed, otherwise they couldn't use binoculars, logically. Rather it's a consideration of how much it enhances the police senses.

Locator tracking beacon on car: The police could've just tailed the suspect closer. They did actually tail him, but the beacon merely allowed them to do so from a greater distance where the suspect could not see. Moreover, the beacon did not tell the police anything other than the location of the car, which they could've seen with their own eyes from a lawful viewing location.

GPS tracking: Goes far beyond the locator beacon. Here, said GPS can tell the exact location of a person in any given room in a building. The difference between this and the locator beacon on the car is that the police could've seen the car with plain senses at any position. Short of technology seeing through walls and floors, the police could not have seen which room in the home the person was in. A similar ruling was found in .... I can't remember the exact name but it was a heat seeing thermal imaging device the police used to see through walls of a home. Basically it reveals too much from a position where the police aren't allowed to look from without a warrant.

Disclaimer: this is far from an exhaustive text on search law and in fact it's merely a crumb. I could write a book on it as it is very complex. This doesn't even touch the "reasonable expectation of privacy," or any other of the numerous factors in the analysis.

Moreover, the bloody warrant had expired....

He has constitutional legislative immunity. But the TSA doesn't seem to want to follow the damn rules. "We're exempt." Huh?

Much as I don't particularly like the Pauls, he has a point. Even if you try for the BS "this isn't an arrest"
it's still "question[ing] in any other place."

I think Cameron did most of those things too, but at the moment the Conservatives seem to be accepting of the Lib Dems' proposals to legalise gay marriage.  Probably because there's a lot of votes to be won and very few votes to be lost on supporting gay rights nowadays.

Wealth is not a static quality to be horded. Wealth is a cycle of flowing money between people. This is one of many reasons why outsourcing/wealth hording is bad--it breaks the cycle.

If I buy from the person down the street, he will in turn buy something else in the community, as will the person he bought something from etc etc, and the community will be stronger for it. The problem with outsourcing is that the money will not return to the US. The problem with wealth hoarding is that it breaks the cycle of commerce and money flow.

The wealthy are the problem, and I'd be just fine without them. They can leave so far as I'm concerned. I want the community to be able to afford my services. Kind of sounds like Henry Ford doesn't it: wanting people to be able to afford your services cars? Of course, this is "socialism" I'm sorry I thought it was the height of mass production and capitalism? The masses have to be able to afford that mass production....

Mr. Ford's investors sued him (sadly successfully) because they accused him of turning the company into a  charity more concerned with giving people cars than making profits. No, he was just so fucking brilliant that those apes couldn't understand him. He wanted a car in every garage and he was right to think it/immensely successful for it. The damn apes investors were too busy screaming for their bananas profits.

I have been told I'm advocating to let the rich solve people's problems. No, the rich are the problem.

I want them out of my way....
