Woah. Didn't expect the thread to take off so quickly like this.
My opinion doesn't really matter here, but since I'm the OP, I feel it would be prudent to speak a few words on it.
As with all things on the Internet, we have no idea of the backstory on the decision to use/sample the DF music. We don't know if the track is final, nor do we know if any more of the DF theme is used in the rest of the track that hasn't yet been released.
Nor do we know (to my knowledge) whether Toady/Tarn were contacted and/or permission granted to use the chords in what will eventually be a commercial product. We don't know if it was simply 'stolen' or whether royalties will be paid for its use. There's a lot of unknowns.
I do firmly believe that they should have their own distinctive theme music, though. No matter what inspired a project, it should not rely on the successes, or indeed assets, of another totally seperate project to prop it up. It needs to be successful for its own reasons; it should be memorable for its own reasons.
I'd love to hear more about this, so if nobody else has already contacted Toady for comment, I'll get on that today. A comment from French Rice Games would also be great to hear (I'm not signed up to their forums, so could someone else handle that?)
Finally, let's not knee-jerk react over it. There's no condemning evidence of foul play, just suspicions based on a very short clip. For all we know, this could all be well above-board. In that case, however, they probably should have made more of an effort to make it absolutely clear that the track is being used with full permission.
Interesting discussion so far though, let's see where this goes.
