Okay. I have to admit. That first bit is pretty blatantly DF. =p Not even "paying homage".

Paying homage is like the Morrowind -> Oblivion -> Skyrim main themes. They incorporate elements of the earlier music into them to weave together the games.

This is... Not. It's nothing to get irritated about, but it's quite blatantly lifted. =p

Well, I've posted on their forums and they seem incredibly hesitant to admit that their sound dude or whatever cribbed the music.  Which is a shame, because the game itself could easily stand on its own feet without that sort of thing.

I agree it's a shame, I don't listen to game music so I wouldn't have known, and I've been lightly following this for some time just because the direction of the project is interesting to me.

Yea, it would our beloved leader that does honer to our ears every time we pay homage to the great works of magma and zombie eagles. I will have to listen to this song myself, because it annoys me when people just blatantly steal work like that. It just sort of cheapens it. SoR looks like a great little game, but I do not want it to be spoiled for me by knowing they were ripping off their music. I hope they are just using it as a place holder or something, because it is a game I want to enjoy.

It's always easier to ask for forgiveness than permission. Seems like a recurring theme in indie game development.

Never 100% sure why this is. Maybe it's because I've got the Anal Gene but when I want to use something for something I'm making that's more than personal use I just ask. Usually people comply.

Though I usually just end up wanting to make graphics, sound and code by myself, because technically I can do all three but at least two of them will suffer.

IMO, they could have tweaked the first part a bit more to make it fit the second part better. (Ugh, my English really sucks here.)

No worries, what you said still made sense.

On-topic, it's one thing to have a song thematically similar, but when you take --20-30 seconds whatever-- like what they basically did, that's a rip-off.

This is what is known as 'sampling,' or in some sense, 'covering' a piece of music.  Ultimately, because they stand to make a profit from it, they could be required to pay royalties.  Whether or not that will happen isn't up to us, really, and debating it is silly.  Copyright law can be really strict, to the point where posting a video of you playing someone else's music on the internet may be considered in violation of the copyright.  It all depends on how far everyone involved is willing to take it.

I suppose Vanilla Ice is "straight up stealing" from Queen.

This is what I mean.  Vanilla Ice 'sampled' that Queen song.  He also payed a lot of money to Queen to do it.  Not really stealing it, but buying it.

He paid a lot of money after the fact, after there was a pretty big controversy and legal actions were threatened.  Pretty sure he ended up having to give credit to Queen as well.  And Vanilla Ice actually changed the bassline's rhythm a (tiny) bit.

Honestly, I don't really care unless Tarn cares. Plus, his opinion is the only one that really matters in this situation, but I don't really see the big deal. Although now that I think about it, they do seem to credit the song/sample to their "talented sound director" when nearly all of it isn't original. I like references to DF, but if they didn't ask permission, I could see the issue.

It's one thing to do a legitimate homage, but it's another thing if Serious Sam flat out uses Duke Nukem's main theme.

That is, even if the game doing the homage is pretty cool, I can't take it seriously solely because it feels it needs to steal assets rather than be original, or put the work in.  It's either laziness or lack of confidence in their own abilities.

Even if Toady, Threetoe and Scamps all agree that is is ok for FRG to use the DF theme music, it just will not be the same as if SoR had a theme to call it's own. It is sad when a game aspires to do nothing more then mimic another, and has no desire to build itself a soul. While there would be no real problem, it sure wouldn't be a credit to the game, and the developers should be aspiring to more than that.

Anyway, DF is a grim and gritty game, that deals with the struggles of every day life on a community level. It sells itself on having more depth than all music composed since the turn of the millennia combined. You can not win, so matter what you do, and almost sarcastically, the catch phrase is 'Loosing is fun'. DF is meant to be some what of a sombre affair, and the music reflects this beautifully. SoR, however, I think would be a lot better if it choose a more light hearted approach, and sold itself as a game where you build might towers, dig vast dungeons and kick some goblin ass. The sort of game where as you do not win not because one day you loose, but because the winning keeps coming. The visual style so far looks to reflect this a lot more than the choice of music, and even some of the enemies seem to be hand picked to bring forth a sense of nostalgia for your 8bit childhood. SoR should feel light and happy for maximum impact, and the music would do well to reflect this.
