If they actually went the realistic route, it would all be worth it just for this.

Anyway, I'm still clinging to the distinction between "filed" and "have".  Yeah, it's obviously not the kind of thing you would normally call intellectual property, especially not Disney's.

It just occurred to me. If a 3rd party can trademark a military unit designation, imma jump all over that shit. 82nd Airborne, 101st Airborne, 1st Cav....MINE! ALL MINE!

Here's a thought--does this mean that Disney would be able to sue the Navy for breach of copyright if they issue materials with the name "SEAL Team 6" in them? And if so, when's the next train out of Crazytown?

Au contraire. People can, and do all the time. The Navy alone has been sued to:

1. Stop construction of an OLF facility in eastern North Carolina.
2. Stop using high-powered sonar in areas frequented by whales.
3. Stop overflights of various urban areas with F/A-18's.

among many other lawsuits. If the Navy wanted to produce and sell a book chronicling the history of SEAL Team 6, and Disney actually has this trademark, then in theory Disney would have grounds to claim trademark infringement. Which is f**ked up beyond all belief.

Surely the Navy has copyright by default on the term it came up with? Or is US intellectual property law even more fucked up than I think it is? I suppose it depends on whether they're copyrighting or trademarking it or both.

That was my thought (and probably everyone else's on the planet), which is why this is serious "WTF" news. I'd love to see how Disney is arguing for their right to trademark something that isn't theirs, and already belongs to the United States government.


EDIT: Oh. That's how. Because the Navy doesn't officially recognize that any such unit exists. Therefore they have no claims of prior title. Talk about exploiting a major f**king loophole.

On the plus side, Novalogic (which have cranked out a ton of mediocre military FPS's in recent years) apparently applied for the same trademark twice before and eventually dropped it because the application was going nowhere. But then, Disney has much deeper pockets and better lawyers. If they really, really want this, it's still potentially feasible.

Trademark law isn't that simple. The intent of it is to prevent brand confusion. For example, you can sell windows at a hardware store because no one will confuse it with windows the operating system but if you sold a windows operating system that would be a serious trademark violation.

Disney can make a SEAL 6 movie and trademark it for that purpose. All it would mean is that no one else could make a movie called SEAL 6, nothing else. What gets complicated is the merchandising.

Unless the political climate in the US changes anytime soon, I am going to assume that the Dragonball and Metal Gear franchises are safe due to their massive amounts of muscular men in spandex and teh gay.

Good enough for me.  Or, at the very least, I'll pray that they'll keep away from my adoration of surrealism =/  There must be some limit to their shenanigans.

I dunno.  A lot of the stories they adapted weren't really very appropriate for Disney audiences, but with a bit (a lot) of tweaking they get there.  Nothing is safe.
