Be locked up because his methods were too cruel. He can't hit hard enough to cause pain of any sort, being a child. The hammer simply brushes past the criminal's skin. As a result of extremely long periods of rubbing with a hammer like this, the victim's skin becomes raw, and eventually is completely removed. This rather painful wound becomes infected, leading to a slow, painful death, spanning the course of weeks.

WWUD If he was in an above-ground house?
