Privacy Rights of AIDS victims in Australia
« on: February 17, 2011, 12:49:07 am »

THIS IS NOT A DEBATE

I'm just asking if anyone knows what the rights of AUSTRALIAN AIDS victims are for a school project. Specifically, the privacy off their details/condition. If anyone can give me a hand that would be great.

I don't really understand what you're asking. Perhaps you could clarify?

I assume its the same as every other medical condition.  IE:  Doctors aren't supposed to blab about the results unless its part of a criminal investigation.

Edit:  I did find this which seems to be relevant:  http://www.privacy.gov.au/faq/individuals#health

I've been given a set of questions, one of which is: What rights does our society have in this situation about AIDS? (The situation being the storing of AIDS victims details in an online database anyone with access to a doctor's computer could access.

I'm surprised your question sheet features such a basic grammar mistake.

No clue, but I know in Canada we need patient consent to store anonymized HIV genetic sequences for pretty much any online database.

I honestly can't imagine the Australian government letting everybody access everybodies medical records.  :)  HIV isn't any different from any other medical condition privacy-wise, so when searching for the answer I'd just look up STD's in general.

Are you sure about that? AIDS is a notifiable disease in most countries.

PD: some gogling on the issue has led me to the  Australian dept of health website:

Any person in Australia must by law declare with any potential sexual partner, no matter the protection used, that they have AIDS. If this isn't done and the person catches AIDS, they can be tried for manslaughter or murder.

There you go.

I assume that particular charge is only if they die, right?

AIDS doesn't have a very high survival rate. At most, you can suppress it with drugs, and those have some serious side effects.

Pretty sure.  Its a notifiable disease here, but that only means that it needs to be reported to the government(which is odd because I don't think we actually do that either).  We certainly can't make patient details public.

HIV has a pretty good survival rate in developed countries with decent healthcare these days.  With the current antiretroviral drugs a patient can pretty much stay in decent health forever as long as they keep taking their drugs regularly.  Treatment has come a long way.

I think it's more the 'doomed', sort of thing. If you knew you had AIDS, and you had unprotected sex with them, then you must've wanted to kill them.

Does not compute.  I'm pretty sure the only conclusion to be drawn from that is "you must've wanted to have sex with them".

We must make some terminology corrections here.

HIV: You are infected with the HIV virus to the extent that it cannot be wiped out by a flush of antivirals. If you take modern medicine(Which have strong side-effects and must be taken at very specific times, and is very expensive) you can survive for decades without any major problems.

AIDS: Your immune system is dying. The HIV virus has destroyed enough of your T-Cells to severely hamper your ability to fight off infections. There is medication that helps, but it's just delaying the inevitable as simple bacteria or the common cold horribly kills you.

And yeah, charging with murder if you spread this without telling your consenting partner. Makes sense as you did just doom them to either take a bunch of medications that are expensive and have a lot of side-effects(Unless you get one of the strains that are immune to modern medicine floating around) or die horribly in around a decade. And if you didn't tell them you had HIV they could go through most of the HIV stage without knowing they have it, the only signs of receiving it taking effect in the AIDS stage.
