Yes he's actually dead. No one seems to have attacked him or anything since no one else bothers to go into that building. Hell I just go into it for the most part to see if there's any decent clothes in any of the boxes.

With the kinds of things I've seen from Oblivion without modding? That's relatively subdued. Glitches, glitches everywhere. At least Morowind has the decency to just crash when everything goes to hell.
