This initiated constitutional measure would add a new section to Article I of the North Dakota Constitution stating, "Government may not burden a person’s or religious organization’s religious liberty. The right to act or refuse to act in a manner motivated by a sincerely held religious belief may not be burdened unless the government proves it has a compelling governmental interest in infringing the specific act or refusal to act and has used the least restrictive means to further that interest. A burden includes indirect burdens such as withholding benefits, assessing penalties, or an exclusion from programs or access to facilities."

Shouldn't that pretty much be the case anyway?

Sounds fairly ambiguous and harmless. It's basically saying, "If they're not doing something illegal the government can't discriminate on the basis of religion", which is basically how everything works anyways. It's not like they're legalizing something controversial, or even something that could potentially be controversial. I don't see any problems here, even in a worse-case-scenario, unless someone can throw out some specific examples.

It does potentially mean that for every act of law enforcement, the government body responsible needs to provide additional paperwork demonstrating that it has a "compelling interest" (whatever that means) and that there are no alternatives that impact the ability to exercise religious beliefs less.
