http://www.bay12forums.com/smf/index.php?topic=43236.msg3026713#msg3026713I did not do the BS "hand the other side their case because they're too stupid to do their evidence right" thing she wanted me to and she threw me in jail for contempt of court. Non compliance with a court order (for which nothing was written? or expressly said? Only hinted at?) I know the bailiff so he took me to a decent cell; he expressed surprise at the magistrate. Three hours later, I was out and had gained a new client (criminal defendants tend to be in jails) from this, potentially more. Also the trial on the credit card thing was postponed or "continued" on account of one side's lawyer being tossed in a cell, so I get more time to work on that case.... I'm also filing a motion with the judge she works for to have this magistrate removed from the case for bias, for reaching a predetermined conclusion without so much as looking at the blatantly inadequate, illegible "evidence." Also, you know, jailing someone on comtempt for violating a court order you never wrote, said, or even gave....
My defense is simply "court order?" What court order? The court speaks through its docket and the docket is silent. There's no court order in the docket. “A prerequisite to a charge of contempt for disobeying a court order is the existence of a valid order.”
Cortland United Methodist Church v. Knowles, 11th Dist. No. 2006–T–0110, 2007-Ohio-3383, 2007 WL 1883273, at ¶ 33. Nothing was said in court expressly giving a command to follow. "Maybe you should consider," as expressed words is an insufficient phrase to constitute a court order.
Id. What were the terms of this alleged order and if you can't tell me that, then how do you know if I violated it or not? She's screwed.
Did... did I somehow win or do something winnish? New client(s?), more time to work on this case, airtight defense to criminal contempt charge (what court order?), filing to have headache inducing magistrate be removed has a good shot....
Edit: Looked into it, she's had 5 complaints against her recently. I'm six?
