Homeowners CAN be sued by burglars
« on: June 14, 2010, 03:37:59 pm »

I forget where we had this debate, but Aqizzar asked me to source, and I had trouble finding anything about it when I went to look (though I did find some kid who fell through his skylights).

Well, I'm not one to back down (clearly), so I went through some sources, and finally went all the way back to the person I found it from.

Apparently, the case of the person falling down the stairs and suing was also hearsay from a teacher of his, so it may be urban legend. He did, however, provide me with this.

Creating traps in your home, at least in British Columbia, is illegal, and you should not do it.

This is such a bullshit thing. Of course we are going to cause them damage. If we were standing in the doorway instead of a boobytrap, the robber would likely try to hurt us. Preemptive self defense.

Creating traps in your house just about anywhere is illegal. And for good reason; imagine if you died suddenly and a relative came in to take inventory of your house. Or if police entered the house on a warrant.

Two sides of this debate.

"I have the right to protect my home by any means."

"You are potentially endangering civilians and law enforcement."

I prefer the first, but thats me.
There can be compromise though, require trap information be filed to the local police department.  And traps be limited in lethality and placement.

Do you put traps in your home? I doubt it for some reason. If you do, I'm very surprised. If you don't, consider why not.

Traps are illegal because when you kill yourself with them someone has to pull your body from your house.

Idea: File trap plans with some sort of office, be it police, mayoral, or funerary. Then, when they need to enter your abode, they look at the plans and don't walk into the traps.

I'd assume you would do something to keep Fluffles from killing you in your sleep.

Best way to avoid being sued by a burglar?

Make sure he can't appear in court.

If you kill the burglar, especially with the trap, you'll still be in trouble and lose thousands of dollars in legal fees. You'll probably lose more than if you'd just let him nick your silverware.

Legally marry them and send them on their way!

Trap? Oh, I forget I'm talking to an international collection of serfs, slaves, and unarmed thralls to the state. No, I'd shoot anyone who came into my house when the wife and baby are home. That's legal in my state, too.
