I thought that there was always a lack of a comma between the last two items of a list? For example:
Colours: Red, green and blue
As opposed to
Colours: Red, green, blue

Technically, it's supposed to have a comma between all items in a list, with the word and at the end, except for a list of two items.
Red, green, and blue.
Or:
Red and blue.

However, it has entered common usage for the last comma to be missing.
Red, green and blue.

Mainly, it's an emphasis thing.
No comma means no vocal pause means association of the two as one item in the list.

What is more understandable:

You must include Red, Yellow or Blue, Green, and Orange.
You must include Red, Yellow or Blue, Green and Orange.

Now, change the order:

You must include Red, Green, Orange, and Yellow or Blue.
You must include Red, Green, Orange and Yellow or Blue.

There is now an evident conflict between "Orange, and Yellow or Blue." and "Orange and Yellow, or Blue.", since you can no longer tell what one it really is.
