I lol'ed, specially because Horatio Caine just jumped to mind... but still, I stimply can't assign anyone to mining, I'm not even using Dwarf Therapist, the mining pick is there accessible and all and I simply can't... argh.

okay so dump the picks and then unforbid them

I've tried dumping then unforbidding, moving them to a stockpile, etc.
Still the same, no dwarf assigned mining picks it up.

Eh, I don't have a forge yet, it's a new fort; gah, I give up, last time I started a new fort on a great location like this another bug screwed it up, think I'll shelve DF again for some months.

What really irks me is that it appears to be a "simple" coding bug, how stuff like "dwarven nervous system" are considered important but game breaking silly bugs like these pass over into release is beyond me.

Probably either they have poor focus as a trait

Focus actually doesn't actually have any effect on things like this.  It's one of those myths.

You can also check for a huge adamantine spire on your map. I'm just saying.

If the picks are assigned to a squad as weapons, they will become unavailable to all miners even if the squad is off-duty. I had a similar problem, which I resolved by unassigning the picks.

How do I check that, via the military screen? I have no squads assign nor did I ever created a squad (it's a brand new fort, first season in)

Actually, I got a caravan who happened to be carrying mining picks and bought one, which the said dwarf promptly got and started happily mining; I guess the original mining pick is haunted? 

Also, is there a bug where dwarves with burial duty assigned to them wont move dwarven bodies to graveyards?

You need to use the 'o' menu to allow dwarves to gather things like that from outside IIRC.
