Well, going back to the news post,  "Gender" is technically what you define what you think you are. So, if you're a male who believes you're a female, then your gender is female. That's why they put "sex" in forms and 'asl'. By that definition, a male who had a sex change to female would be female by gender, and not "intersex"

It's kinda pointless to be "intersex" anyway. I mean, it's not like they look at your driving license and ask if you can make babies. Your sex shouldn't matter at all for most official forms, even a lot of job applications. If it's for a job application, your present sex should be sufficient, just for the uniform. And if it's to reduce discrimination, like women not getting jobs, I'm pretty sure "intersex" would be the most strongly discriminated against sex.
