The party meets up with the Guardsmen, and ascends the upper staircase.

from the top of the staircase they can see into a room overlooking the courtyard. There are several of the Duke's personal guard aiming out the window with crossbows. They appear to be taking potshots at the rioting peasants! The fiends!

They have not noticed you yet. Move closer and initiate combat!

Initiate combat, try to get a surprise round or something.

Actions: Firebolt any crossbowman that looks like he is ready to fire in the first round, if they are all reloading, choose the one with the least teeth.

Raith once again held his head in hand "We could have pushed them out of the window. instead you scream your entrance and then threaten the bludgeon the enemy if they don't stop doing evil. What are you, a paladin?" He then gets into battle, since all other options have been closed.
