That's... one way of putting it, I guess.  I will say that mandatory attendance stretches some constitutional definitions of assembly, although the obvious counterpoint would be that you can get private schooling or home schooling if you don't want the public one.

It's worth mentioning of course that things didn't always work that way.  Less than a century ago, school was purely optional.  Of course that was in a day when formal education wasn't necessary to be a functional member of society.

If you really wanted to, you could make the argument that the Constitution (or the 1st Amendment anyway) should protect your freedom to be an uneducated troglodyte.  But I would call that a stupid argument.

School or not, you have that freedom anyway.  Consider how many students fail to earn a diploma and how little many high school graduates in the U.S. have actually learned.

The point is, the fact that you are mandated to attend some form of educational institution from at least the ages of 6-16, and pass a certain level of judged competency along the way, means it's a matter of law that you have to at least try to pick up a semblance of analytical ability and socialization.  At the ultimate interpretation of the freedoms of speech and assembly (including the freedom to not be mandated to assemble), you could choose at six years old to never go to school or leave your house, and the (federal) government couldn't say squat.

But I think that's a ridiculous argument that I would never support the content of.  Just it's functional existence.

Says whom? Show me documents.

Tinker v Des Moines (393 US 503 [1969])
Keyishian v Board of Regents [385 US 589 {1967}]
Bethel School v Fraser (478 US 675 [1986])


Tinker v Des Moines is the major case in this instance. This is about freedom and students, I'll probably be back later with minor in general.

Minor also have other more serve limits. Minor dont have the right to own fire arms, go into a free contract, ect...

Tinker vs. Des Moines actually turned out in favor of the students, who most certainly WERE allowed to wear those anti-war armbands.

On a slightly related topic, the longest word you can type on the keyboard with one hand is "Stewardesses".
The largest word you can type with a single row of keys is 'Typewriter'. Interesting, no?

I say that if someone decides to be an "uneducated troglodyte," they shouldn't be eligible for welfare and all that. It would be just stupid to give money to people who willingly contribute nothing to society.
