If *California* will pass a law banning same-sex marriage I don't think Texas will be getting it any time soon.
Long story short, no Federal court is willing to touch it, but an ugly legal reckoning is only a matter of time.
I think they are but the timing is terrible. Obama appears to be willing to from my reading into it but seems he will not push political capital heavily into gay rights before he's up for re-election. At any rate, there's a split feeling there while the main legal homosexual rights group has canvased him as their strongest ally in the White House yet. The Supreme Court would be an interesting split, you may be able to get civil unions but unfortunately most of the country would backlash against gay marriage.

It's stupid. As people, homosexuals shouldn't have to settle for anything less than full rights.

As a Californian, the measure barely passed in a large state that while is touted as extremely liberal, Prop. 8 advertised in a dirty and low manner religiously (Funded by Mormons) and "won't you think of the children" leading to most of the older folk voting for it.

If we have to put rights up to a vote, seems our generation will have to wait for them to scratch it before justice is served. I hope you all don't have to wait that long :)

After procesing it a bit I have concluded that on top of beding sad, I'm also MAD AS HELL on the Stupid f**kers who deal out hurt along arbitary divisors like this! >:(

I would argue that wanting senile old people to die is somewhat difficult to accept with open arms.

Yeah, it's totally right that she should be forced to leave her friends, family, job and other ties so she can have something that is given to most people as a basic right.

No ones forcing her to do anything, Im just saying if she really wants to get married she should move somewhere that allows it. The uphill battle of trying to change that conservative hivemind isent her responsibility. Eventually gay marriage will be legal in Texas, but it wont be anytime soon and theres nothing she can do about it.

I feel kind of bad for spieling this out, but there actually is something an enterprising (and necessarily rich) homosexual couple could do to change Texas' law.  It would involve temporarily moving to a same-sex marriage state, then moving back to Texas, then engineering or waiting for something to happen where the normal legal rights of marriage would come into play, like hospital visitation or something.  If that right gets denied on the grounds that the out-of-state marriage isn't valid under Texas law, then the long long long process of appealing up through the court system begins.

Basically, trying to set a legal precedent that the Texas law is untenable under the Federalism clause, and just keep kicking up to the next higher court until either the law gets struck down or annulled, or you run out of money, or until the Supreme Court decides to enshrine a specific exception into the First Article over an argument of emotion.  So yeah, it's doable, and will probably happen someday.  But bring yer lawyers.

So they'd have to be a rich couple willing to devote a lot of time and money to a cause.  It's sad that someone has to spell that part out.  :P
