So the kitchen is currently under quarantine for the next few days due to the counter tops being redone. This is going to make getting food over the next few days rather difficult, we're getting chinese tonight, but I get the feeling I may have to leave the house in search of food at some point.

There would have been an event this weekend that I've been waiting for months, but I apparently caught a flu just in time. I could go semi-conscious from painkillers and attend any way, but decided not to.

I haven't had time to play df since the minecart update, though.

The state bar and ethics people are giving me shit about calling it a "law office" instead of a "law firm" for my solo practice. Really?

Don't you guys have drunken attorneys to go after who aren't me?

You know, the ones who let it interfere with their work or show up to court hammered...? Or I mean something else besides a one word difference? It's good to know the state is admitting to being at least $8 Billion upside down but what little resources we have are used like this...? Balls.... Really?

I will admit it seems incredibly inconsequential, but it is ultimately valid in that to declare a "law firm" as a "law office" is equivalent to attempting to have a sole/general/limited liability proprietorship or legal personality pass for physical property.

I will admit it seems incredibly inconsequential, but it is ultimately valid in that to declare a "law firm" as a "law office" is equivalent to attempting to have a sole/general/limited liability proprietorship or legal personality pass for physical property.

Aside from my having a physical office, that's not really the issue.

The issue is one can't be "deceptive or misleading" by the state's crazy definition. Specifically, here, this relates to the number of attorneys in the practice. For example I couldn't say "John Doe & Associates" because there is no one else but me as a sole practitioner. The question then is does the use of the world "firm" imply more than one attorney.... Thankfully the state has said that it can but doesn't necessarily and it certainly doesn't anymore than does "office." The term "office" is allowed specifically and the state has apparently said the word "firm" is also allowed for sole practitioners. Thus number of attorneys rather than physical presence was the issue.

There are numerous insane rules like this. Though I am far cheaper than most other attorneys, oftentimes literally charging half their fees or less (and I can confirm this because I know nearly all of them), I cannot tell the client that specifically. Moreover, there are a number of taboo words I can't use (some of which I don't want to use) related to this. Simply there's a whole crapload of paperwork involved in setting up a law firm and most of it seems redundant. [shrugs].

In other news:

It seems the program "Freecorder" is no longer what it once was. My laptop has the old version and it works awesome for recording any video or audio off your computer. Lots of evidence things were far easier.... Anyhow, the problem specifically is that they have now in their new version teamed up with malware and browser hijackers that have infected my desktop. I did a factory condition restore after backing up my files on two 3 TB external hard drives (no loss of data). The damn thing is still there in the background. Though it no longer hijacks my browser after my diligent file deletions it still has problems. For example, right now my CPU usage is going crazy: jumping between 25% and 82% usage. All I have open are one Mozilla Firefox browser with one tab open and task manager.

I suspect this means I have a master boot disk writing virus. So I'm going to give in and take the tower over to a computer repair place. Before I do, I have to sanitize my computer of all client files etc. (backed up on external hard drives, etc). I also plan to delete anything that outs me as transgender, such as e-mails, correspondence, etc.

I really dislike it when my livelihood is screwed with. Plus it's Memorial Day Weekend so that'll take longer....

The primary thing I'm worried about is the CPU usage often going to 100%....

oh dear lord...

I'm surprised that, with the CPU usage going that high, it hasn't melted in a few moments.

Through carefully ending processes, and minimal use, I can usually manage to get the CPU use down significantly, but yeah. I'm looking at $125 to get the whole thing fixed, hopefully by Tuesday it seems. Meh. The guy behind the counter seemed to actually think I was a decent human being instead of a customer, probably on account of my being polite instead of a demanding jackass... aka "a customer." So hopefully he won't firebomb it. :P

As compared to the ones that are such a persistent jackass the poor workers do what they want just to get them to go the hell away. Works an annoyingly large amount of times, from what I've observed, but so much more effort when politeness can get the same thing done in half or less the time and a terribly small fraction of the energy.

It is intensely embarrassing to be family of someone like that when they decide to use that tactic. You just... you just want to go up to the poor worker and say, "I am so very, very sorry." Which I've done once or twice, I think. Doesn't come up very often, fortunately.

My dog is sick. Coughing. Shaking. Curling up underneath my chair. The whole nine years. He also got a bad cut on his foot a few days ago. I hope it is not infected or something.

Do not understand clients.

DUI (OVI) comes in, tells me everything, says he can't pay much.

I explain that quite frankly if he shops around, he's gonna find the average is $200/hour and it's not uncommon for lawyers to charge $300/hour.

I gave him a can of coke. I offer him $125/hour and the promise to cap what I get at $2000 maximum. The court costs are whatever the courts say. I'm guessing $200 roughly, but there's nothing I can do about them seeing as they are set by the courts....

He still calls me an asshole.... I dunno if he's still pissed off the judge said he can afford to pay for his own lawyer (not getting public defender) or what.

I'm not getting this. Really. I'm already cheaper than most and I'm both knocking down my rate while capping the maximum amount owed. I've never even seen a lawyer do that. Go to the doctor when you're sick and see if they'll lower their rate and put a cap on your med bills.... They won't.

It isn't like the office landlord or malpractice insurance guy is gonna give me a break....

Quite frankly, if he ends up finding out what lawyers usually charge around here and comes crawling back, I'm not sure I should be giving him the better offer I extended before. Really, with the average price being $200/hour, he'll burn through $2000 in 10 hours--very probably before he gets through trial.

I don't know how you get so many asshats, Truean. Most of the people I know that have been through a court case have at least been respectful and understanding towards their lawyers.
