I'm specifically not saying Wendy's ought to get its way, even though I'm sure it has more brand recognition even in the EU. 

You'd be wrong there. Europeans don't have a clue about US megacorp foodchain names unless they are rich enough to have been on holidays to the US.
Personally, I had never heard of Wendy's, or Five Guys, or TGI Friday, or Dunkin' Donuts before I read the names in the newspaper yesterday.

Don't overestimate your country's brands.

I say they don't deserve anything. They already turned a significant portion of your population into fat, heart disease prone people who'll die before their time. I think it's bad enough we got McDonalds and KFC, I wish they'd stayed in the States.

Of course I don't expect Europeans to know of Wendy's!  I don't have the faintest knowledge of European chains.
But I'm much more aware of Tim Hortons, despite never seeing one in real life, than I am of some 2-location startup in Tennessee (adjacent state).
Still though, the guy did register in the EU first, and he deserves to keep selling his product unmolested.

I knew a lot of US food outlets even before I visited the country, but then I suppose I speak more-or-less the same language that is spoken there so perhaps it's not quite the same... pretty sure I learned most of the lesser-known ones off Reddit and such sites.
