I wonder, how many people who claim Pirate Bays innocence have unlicensed copyrighted material on their own hard drives?

Or, to bastardize an overly used cliche:  "Methinks thou dost protesteth to much!"

Law is relative, the only sin is getting caught, thus Pirate Bay is not innocent.

That's a good point but it should read ... is getting convicted, thus...
They *are* innocent, the trials aren't over.

I doubt any companies are involved in the prosecution, it's all just lobbyists who've gotten their panties in a twist. The same lobbyists who probably tried to sue sony for selling vhs recorders, knowing full well what most users would use them for.

In Kafka's 'America', there's a scene where Uncle Jacob gives K the key to changing the layout of his desk, but advises him that he would really prefer K leaves it as it is. That's the only way freedom and trust can work.

I always enjoy reading discussions like these. I hated it when the last one died.

It made me so sad, but now I'm happy again.

Donationware only works with a product that's still awesome with all its bugs.

Well said.  ;)

File sharing IS piracy. When you create a torrent a site, you know already, that most of the "users" will [illegally] download movies, games, mp3 files etc. -> Those torrents should be deleted, correct? Question: Did they ever delete any illegal torrents? I guess the answer is: no.
Sheesh, peeps, do your homework. The PirateBay IS NOT A FILESHARING SERVICE FFS. There is a difference. Well, technically, they are, but the only thing they are sharing is legal plain text, called "trackers".

The tracker is nothing but a pointer to the (probably) illegal content. The tracker is the ONLY thing that is hosted by the piratebay. And we dont care for intention or whatnot, since you can hardly prove (in that context) what the owner wants.

The lynchpin of the whole thing was the trackers being LEGAL in sweden for quite some time, you hear me? LEGAL.
And as far as I know, this changed recently (thats where I stopped doing my homework), and that's why they got screwed over.

if there havent been large companies with large amounts of money bribing and pushing the swedes, things would have remained unchanged, and I find it disturbing that you can get your courts in a shop, basically.

Yeah, you are downloading the illegal content from other people's computers. However -in order to do this- you need to download the torrent from the site. The torrent was hosted by piratebay. Correct?
So the question is this: WHY didn't they deleted the illegal torrents? If they would've done that, I am pretty sure that the site would still operate.

That's a question I cannot answer. I pointed out in the prior post where I stopped doing my homework.

I cannot even tell for sure whether or not the torrentfiles themselves ACTUALLY became illegal in sweden (but iirc that's what happened).

I can only guess and assume, and all those guesses go into the general direction of "the piratebay guys must have some sort of ace up their sleeve that convinces them that this change of law doesnt mean jack".

Again, the "illegal" torrents became illegal only very recently. <- Lynchpin.

As I understand it they operate under the same system as most sites containing content uploaded by users work on, if you complain about a certain file being illegal they will remove it. After all it's impossible for them to vet every single uploaded file. For perspective they operate under the same system as YouTube regarding illegal content.

Actually, no, they didnt (Because, in sweden, a tracker NEVER was illegal... well, so maybe you can argue, they operate under that policy, but it never mattered, since there never was an illegal tracker, and now that there are, they have to remove those, but they didnt, prior to the case, because of the reasons you stated).

In fact, their "legal threats" section was one of my favourite reads on the net.

Lawyers from sony going "STOP THAT!" and the pirate bay guys answering in different elaborate manners "SCREW YOU". Hilarious.

My favourite went like this, somewhat:
"They sent us a 1.8mb PDF letter. YES, a pdf, not just a plain text email. So we sent em back this:"
"this" was a 5mb gif (or summat) which was basically just a bad MS Paint-ing saying "I can use annoying filetypes too"

It isnt correct. Hosting means that a service-provider has the file on his servers HDD. By this he can delete the file.

TPB on the other hand has a tracker. A Tracker just seeks on all connected PCs ideally for files which match the parameters you have given the tracker (Filename/filetype)and forwards all answers to you without looking at the answers himself.

It works like a "I seek a ..."-Add in the newspaper. The newspaper only got payed for placing the add. It never gets who is calling you for offering the stuff you seek.

Similiar is the tracker. The Tracker just has no files on his servers HDD nor can it look into any Files on the PCS of the users.

I couldn't give a rats ass really. It's nice that they found a scapegoat to cling on to and I have to say, Piratebay.org really had it coming the way they publicly taunted any effort to sue them and how they lauded their own piracy and invincibility. What this means is that other torrent sites now have a larger range of movement, which is good for the piracy industry all around.

Besides, that site wasn't that great anyway... with the disgusting search engine coming to mind.

People can bicker over the definition of piracy all they want, but in the meantime, we'll capitalize on their indecisiveness.

I dont actually know how to use torrents so it doesn't bother me. Piratebay can rot in jail for all I care.

How do you use torrents anyway?
