You're thinking about this too modern.  Once a government has been established that doesn't require divine right to rule you've side-stepped most of the problems (in favor of slightly different problems).

However, why should your guard force (police, army, random citizen) not just kill the idiot?  There's no eternal stain for having committed murder, and they really really hate that guy...

But that happens in religious communities...

Yes, but they have a reason.  They're sending the criminal to face his sins against god, who will be the judge.

In an anarchist state people kill people for little or no reason at all, "He had a TV I wanted, so I killed him."
