If it was forbidden after he equipped it he will still carry it and use it.  That is not a bug.

If you want him to drop that pick and get another then you can set the pick to be dumped in your refuse pile.  Another dwarf will chase the miner down and grab the pick out of his hands.

wow i always thought they would loyally dump their picks, but i guess they stick it to the bitter end
