Understanding Justice system/laws

My basic question is

Are the laws that determine criminal acts tied to the ethic system in the entity RAW file?

I tweaked the personality traits of my dwarves to be more violent and vengeful which causes them to get into a lot of fistfights, but it doesn't trigger the criminal system even if the fist fight turn lethal.

In the entity files the punishment for assault is serious and punishment for murder is capital punishment. But I wonder if that is just for diplomatic opinion modifiers. In the DF wiki it seems crime is only connected to tantrums, but tantrum to my understanding always either result in dwarf going berserk attacking other dwarves and getting killed, or get into depression, take off all his/hers clothes and go on hunger strike until death. So tantrums doesn't really effect justice system at all unless I'm mistaken.

The injustice system is basically broken, currently, so I don't enable it.
It kills random dorfs for failure of the fortress to fulfill impossible mandates and it very rarely detect any actual crimes. I believe the overseer can convict dorfs, but there may be a crime detected first (and mandate failures don't count: the noble has already tossed the blame dice). Forget about the issue until the law & custom arc.

Tantrum is when a dorf snaps due to stress and starts to destroy things and hit random people and animals. Tantrums can be temporary and cured with a lot of manager attention, I think, but they can also be permanent due to insanity. Other insanity paths (like the other ones you described) beyond tantrums exist as well, though.

Lethal "non lethal" brawls due to heated arguments do not seem to be picked up by the injustice system, nor to lethal brawls due to inebriation.

Back in v42.x when stress can push in individual to tantrums by either attacking or destroying things will trigger witness reports of crimes, when the captain of the guard position is filled (enabling justice system).

The punishment is dealt by the captain, or anyone in the captain of the guard's squad.  It seems like hammering, punching, or using the current weapon will be used when there are no rooms set as jails via restraint furnitures. 

The un-criminal brawls seem to have become more prevalent since the tavern feature is released, and most likely to happen when a bartender is assigned to constantly give drinks.

I have not seen major changes myself from modifying ethics, and I've been testing that for a new civ. I've hardly been looking for it specifically, but I would venture that it affects civ relations and not intra-fort JUSTICE.

For reals though just set up 3-4 cages ASAP for justice or you will have problems. I had a recent memorable case where the legendary-axewoman captain of the guard almost went berserk from stress because she was forced to beat the shit out of her lover when one of the 4 barons missed out on his production order.

I had no idea about Justice at the time I played Breadbowl.  I had a mace dwarf soldier, and had an adult daughter "As" who was in and out of depression. 

As I oversee the fortress, "As" started punching the "Mayor Quasar" while they are attending a meeting in her (mayor) office. 

Not sure what to do, I stationed my individual mace dwarf in the room, but he did not do anything. 

I panicked and removed him from a squad and assigned him as Capt of the Guard. 

The fight stopped, but it was just coincidence, but I thought assigning me as CotG worked to stop the fight.

Anyway, my turn was done. 

The next overseer enabled the justice screen, and so my macedwarf capt of the guard commences beatdown on the culprit "As" and killed her.  My dwarf's adult daughter. 

Fortunately, that overseer's turn did not continue so that the next overseer reverted to the prior save.  It did not happen!
