By letting those who try to "improve" the empire from their own point of view out of prison while simultaneously giving them a reason to think of others (Their emperor, for example), we become merciful. They can keep doing their occupation as hoighty toighty nobles that do ... something and their families serve a purpose by reminding the nobles that life is sacred, Especially when it is in the hands of a just Emperor.
