The entire case was a fabrication. The supposed gay man looking for a website is in fact: straight, already married and is a web designer themselves.

This is fucking madness. The court won't do any due diligence, doesn't require claimants to do due diligence (unless I guess they're left-leaning) and can rule on fictional, hypothetical issues to pass law.

Wasn’t there a hypothetical they refused to consider in relation to Trump? It may have been congress/senate related, possibly as a consequence of the insurrection? I can’t remember.

From what I can tell based on chatter in law spaces, the media is massively misreporting the case.

The facts that 303's work was considered speech and that Colorado was going to enforce the law against them were stipulated by both parties. These two facts give SCOTUS all the reasons to consider the chilling effect, which gives standing, and as a trier of law SCOTUS usually do not question the facts on the record. Not even the dissent questioned the standing in the case.

The fact that Colorado didn't do its due diligence to check if the request was real or not doesn't matter, Colorado had already proven its intent to compel speech.

This reminds me that I keep wondering why every state has a separate DMV, driver's licenses, and so on.

The literal answer is that it's not a power explicitly given to the federal government in the constitution, but it seems like a perfect example of wasted resources and effort.

The thing I find most egregious about it is there is - among hundreds of thousands of emails - one email from a Ukrainian implying he was asking for a meeting with Biden senior, whereas Trump’s brood met up with a foreign agent explicitly because they offered flak on his presidential opponent - which is actually illegal - which turned out to be a lie and they just wanted to meet Trump senior.
