Just a brief diversion, if you will, on an American thing that aint (directly?) politics. Or indeed religion. Just heard about a derailed train (hit a truck in Missouri) which has killed at least three people. And in the news article it mentioned an accident yesterday (hit a car in California) that killed three people, an accident last September (derailment in Montana) that killed three people and an incident in 2018 (wrong track, wherever it was, and hit a goods train) that killed three people.

Without going all morbid and looking for all the other railroad accidents that were for some reason not mentioned (surely not just a cherry-picking according to fatality-count), this coincidence just strikes me as far more interesting than it probably should be. And not in the manner it ought to, either.

Even if this coach is sincere and has religious tolerance, others may not. The underlying risk is the development of "religious custom" that isn't religious, but exclusionary.
Like, don't even a little give them that much credit. Everything I've noticed about that case gives zero indication the coach was sincere (this is actually pretty close to impossible, 'cause the guy claims to be christian and there's extremely blunt scripture on whether or not that sort of public prayer is acceptable behavior) or had any tolerance whatsoever for other religious positions (pointedly, if he did, he would have gone along with the school's other attempts at accommodation that would have easily avoided issues on that front). This was exclusionary from the start, and in a way that was an outright violation of the scripture of the coach's own stated religious affiliation.

Not sure if this more appropriate for "random thoughts" thread or here... but I wonder, has anyone tried making an "AI" (yes yes I know the current state of the art) that tries to generate "optimal" court rulings?  Instead of, oh, I dunno, trying to get optimal advertising or something annoying like that?

I wonder how you'd avoid bias in such a thing.

For example, this case would be weighing states rights, women's rights, value of life, burden of care, propensity of a law to have loopholes or otherwise be misused, etc. etc.

Even if we assume that we can train an AI to this degree... What training data will you use? History of court rulings? Garbage in, garbage out.


Yeah I don't really trust AI with such things.

Fuck, even as a card-carrying Christian Socialist I think this level of religious influence in government is unacceptable.

It said in the link what it is, the chapter to a book about Gandhi directly related to the post above mine.

Also displeased by your implication I am a fan of Lenin. Perhaps you are unaware of the historical consequences of being publically accused of this in my country. The chapter described Lenin's thoughts on means justifying ends, but confuted it with the argument that bad means lead to bad ends as posed by Gandhi.

I do admit I could have been more descriptive of what the link was, but I thought it would be self-evident especially as I posted the whole thing for you.

Can't speak for anyone else, but the problem for me was that you did post the whole thing. And nothing else.


I forget if I replied before or after IP's interjection, but theirs was clearly along the same idea as what had internally transpired for me. But with better humour. I think I was blunter, albeit intending to be helpful in the one thing you might provide. (Ah, I remember now... I mentioned TL;DR;... Asked for a summary. But maybe not recognisably so.)

Don't ask me what the summary should look like. I'm bad at them, obviously. But if you can boil it down into no more than a dozen paragraphs, maybe..? If you still think it worth it.

He noticed two U.S. Marshals guarding the house and walked a block and a half away. Then he texted his sister, who convinced him to turn himself in.

That's an assassination attempt, foiled only by the presence of guards outside Kavanaugh's house. If Kavanaugh himself wasn't home, the Marshals probably wouldn't have been there, and his family could have been held hostage or killed. (The House passed a bill increasing protection for judges' families weeks later.)

If this guy is guilty imagine how much worse it would be to break and enter some official shit... I'm afraid to find out how galaxy brains will twist themselves to "relate" these two incidents together. Not even gonna name the other one.

I suppose he would be guilty of conspiracy to commit an assassination, rather than actual attempted assassination.  Certainly a big difference between the two.  I don't know if there are any penalties for simply planning a crime though.  That borders on the line of a Minority Report sort of dystopia, whereas up until the act has been committed, I think people can come to their senses and change their minds.  It sounds like the presence of the security team was enough of a catalyst for this guy to do that.  But there also seems to be a gray area where the crime has started but was not completed where some sort of consequences would be useful as a deterrent to others.  Like if you shoot at someone and miss, that seems more of a crime than just shooting at a trash can, even if the results are the same.

Hopefully nobody notices. Insanity pleas vs. public officials usually close the door for future insanity pleas.

But otherwise good legal analysis. He'll probably plea to some Weapon Possession Charge when people stop paying attention to the story.

Given (not to turn this into another gun/no-gun thing) he wasn't the guy who killed a Subway employee for putting too much mayo on his sub, I'm not sure what to make of the "backpack/suitcase full of stuff" detail.

Nobody in their right mind[1] would rock up so unprepared (relative to how they were overequipped) and just because there were two 'guards' outside then saunter past and then have a conversation. Sounds more like having put together a mishmash of items in order to do the equivalent to suicide-by-cop as a fake-overdose episode is to a true and fully-intended overdosing event. At first hearing, at least. I get no more nuance from this than what I just read here, likely lacking much reported/unreported detail that either makes more sense or sends us much further down some other weird rabbithole.

Thirty-seven rounds? I'd take more seriously the person with far more rounds (making wild full-auto firing possible) or fewer (one or two shots per person, ideally, perhaps save the last for yourself if you pride yourself in your professionalism) but that sounds more like "all you can scrounge up, when you don't have a ready supply". Admitedly that I'm more used to Hollywood scenarios... Either Rambo typo or the cool calm types that have that uncanny two-taps-at-most thing as they trivially deal with whatever uzi-weilding mooks they can't take down with more silent moves.

So, I know reality doesn't flow like those seen on film, but my brain is even now trying to write a (relatively) plausible screenplay to explain this whole thing. In one version, he didn't even carry the listed stuff past the guards! Because he (or someone else) just needed it to have seemed to have been done, without the risk of anything sparking off. I'm sure, though, that some times I do this sort of outguessing I end up nowhere near the level of the madness of the reality.


[1] Yes, this is perhaps the point. Sectioned under the Mental Health Act, or the US equivalent would seem to be the obvious 1IA, rather than criminal proceedings.

So before we go any more off-track here, I want to point out that this mention of the rando bumbling his way over to Kavanaugh's house was in direct response to this:

The crazy thing is there was a whole ass leak of what was going to happen, but the Democrats did almost nothing substantial in that timespan to stop Roe. vs Wade from being overturned. lol

Needless to say, that is not an actual answer to "what have the democrats done to try and protect the law" unless you're into that deep state conspiracy bullshit.
