The SEC might think he was trying to alter stock prices by making a false statement of intent.

However, if he really did intend to take the company private (which I could well see), his assertion of that is hardly what I would consider nefarious.

It was only after investors shat a purple cow out of their collective asses that he retracted on the plan to do so.

I should clarify, because my earlier post was mistaken- the problem is that he said he had the funding already arranged in that tweet when he most certainly did not. You can't do that.

Yeah, that was the problem, he claimed he had funding when he didn't, and to top it off, the tweet caused Telsas stock to change dramatically, which is likely partly what grabbed the SECs attention.

I've also heard that he calculated it by doing something 20% and then adding a dollar because he thought his girlfriend would find the marjuana reference funny. I don't think adding a dollar 'because his girlfriend thought it'd be funny' is neccesarily illegal, but it's not a great look either.

Kavanaugh was confirmed by the Senate Judicial Committee. Tomorrow it goes to the full Senate.

It's not clear at all that he didn't have the funding arranged. He might have had it arranged. But there were other factors that came up that convinced him otherwise. I know he wanted some unreasonable plan to still have large numbers of investors able to still own parts of Tesla despite laws limiting the number of owners of a private company. I know chunks of his board didn't like his plan either and may have talked him out of it. It's impossible to say what sort of agreement he might or might not have had for the private funding. What is clear is that he didn't do any of this by any of the procedures he should have. Didn't have any proper legal advice. Didn't really talk to anyone else about it before blurting it out. That was not cool.

I don't think they have yet? They're still taking a key vote at 1:30 pm EST.

Top Dem operatives are already talking impeaching Kavanaugh. So, things are only going to get nastier. The SCOTUS is also going to run into a real credibility crisis because Democrats are going to question Kavanaughs legitimacy, especially if something Russia-Trump related gets to the SCOTUS.

Yeah, no vote yet, but it looks like they have the votes needed to pass the committee.

As a quick step away from this, perhaps try not to tick the "I am a terrorist box".

(edit: Or, maybe, 'the "I am a terrorist" box'... Which I was sure I'd written first time round. And hello to all my friends in the NSA/etc, given how many times I have used the words "I am a terrorist" in this post. Including just now.)

That check box is about on par with the mistaken belief that if you ask an undercover cop if they're a police officer, they have to tell you the truth.

I believe a french guy told security something along the lines of "lol yes I have a bomb in my shoes" and ended up serving ten years, something of the like.
I mean... seriously.

It kills me not to be able to find it. It was a big deal back then.

Ah yes, it was in 2004. Dude spent too much time in the toilets because he was sick, attracted attention of security. "Can I shit please ? I don't have a bomb in my shoes", and bam, four years behind bars. Can't find an article in english tho

So, Jeff Flake, after saying he's vote for Kavanaugh, and then being confronted by a few sexual assault victims, up and left the Committee room almost an hour ago. Nobody's sure what's going on, but some people are looking happy and some people are looking angry/frustrated. It'd be easier to tell what was going on if they made the staffers all wear team logos to say whose staff they're on. Tough to keep track of which senator "guy with grey jacket and primary color tie #6" belongs to

That seems like the dumbest question ever, like do they really expect a terrorist to actually reveal themselves? Not hugely unlike the question asking if you ever committed a felony, not likely to actually work (though your honesty is more on the line there), but it's required.

Yeah, things seem to be happening with Jeff Flake. https://www.cnn.com/politics/live-news/kavanaugh-senate-committee-vote/h_d5503c185230fa5128204f1d3b11c470

Ok, so Flake has agreed to move it out of the Committee, but has said his support on the floor vote is contingent on an FBI investigation taking place. Which is a decent win.
