I'll be honest, it sounds stupid to me.  On the levels of Best Propaganda.  Sure, I get your intentions behind it, but it is pretty much equivalent to tacking on a bogus charge in the realm of public opinion...
And... you either have a sane judicial branch who doesn't buy into that shit.  Or alternatively, you have a judicial branch who laps that sort of shit up, perfectly willing to tack on 'attempted gun crime' onto the list of charges.

It's the standard that we routinely apply to terrorism.  Attempts to blow up buildings that are foiled at the acquire explosives phase for instance.

We dont apply it to guns because it's easy to identify terrorism at the acquire explosives phase but hard to identify gun crimes at the acquire guns phase.
