Gay marriage has been legal here for over a decade and we still have toll highways (although it's a legal requirement that there always be an untolled route as well, condition not guaranteed).

I don't know what that says.

it won't look good if it refuses to go on a single recess just to keep him from appointing a Justice, and there are a lot of GOP seats up for re-election in swing states this year.
It... doesn't matter if obama appoints a justice during a recess? They still have to be confirmed once the senate is back in session, if my understanding isn't entirely wrong, and we can be fairly close to assured that's not going to happen this year. Something along those lines, anyway.

They would indeed need to be confirmed after the recession is over, but it would give us 9 Justices again in the meantime. Here's a quick rundown of how the current SCOTUS situation is going to affect their docket this year, assuming we're down to 8 Justices until at least after the election.

There are plenty of attitudes that can lead to toll highways. I would not assume it is a conservative thing because my conservative state has zero.

In particular I think the EPA climate plan is key.  Any republican president is going to fuck this up so keeping the court from fucking it up until the next justice is nominated is all the EPA needed anyway.  That is something of sweeping importance because the US pulling out of the deal is the only significant danger.

I wikipedia'd toll roads. The majority of toll-road-less states are in the south and west:
