It... doesn't matter if obama appoints a justice during a recess? They still have to be confirmed once the senate is back in session, if my understanding isn't entirely wrong, and we can be fairly close to assured that's not going to happen this year. Something along those lines, anyway.

The most important rule to bear in mind now that the Court is likely to remain evenly divided for the foreseeable future is that, when the Court divides evenly on a case that is pending before it, the lower court’s order stands and the Supreme Court’s consideration of the case has no precedential value. Ordinarily, it is as if the justices never agreed to take up the case in the first place.

In particular I think the EPA climate plan is key.  Any republican president is going to fuck this up so keeping the court from fucking it up until the next justice is nominated is all the EPA needed anyway.  That is something of sweeping importance because the US pulling out of the deal is the only significant danger.
