The former, yes. They are fully scum.

Yes, and most players hate convert games for that reason (they're regarded as a strictly bastard-only mechanic on other sites).  But in this particular case it's worse because you're giving the townie the choice, and thus forcing them to play against their long term interests.

It's also insanely swingy because the mafia may randomly gain an extra member.

Basically having them die if they try to protect a mafia member would be a lot less aggravating and swingy.

I was happy with becoming Ronin being a soft losecon for Samurai.

But I am definitely going to keep the convert mechanic. It's interesting, historically relevant, and I think it'll shake up the game a little.

It honestly is a mess of a role, and I want to end up with it as my role.  I want it just to use as we enter LYLO: either I significantly increase my team's chance of winning, or I win instantly.  (There's kind of a problem visible there)  Or I get nightkilled, but who cares about that?

I personally think it's really cool, it's like a doctor/meson, and I'd be really happy if I got it.

Personally, though, I'd probably use it the first night if I did get it. I wouldn't wait.

If you're playing to your current win condition you shouldn't use the ability at all ever.

Which is removed by simply making it a losecon.
If you get scum-ified, you get notified of your loss as the Hattori get their hooks into you for the rest of your life, and then you have to continue playing.
Not playing against your long-term interests, you've already lost.

The role, like the arquebus (or the Oni, before it's buff) is built towards risk-vs-reward.
If you, personally, would never use the ability at all ever, that's your choice. But seeing as you haven't actually marked yourself down to play, it's not exactly your problem, so I expect it won't be keeping you up at night.

A: Expect them to continue playing after losing and hold faith
or
B: Expect them to play against their wincon and hold faith

I'd do it. Judging by your actions in previous games, you would too.
