To preemptively explain what happened here, Durkon didn't "cast defensively".  He basically focused on casting instead of dodging, letting Roy hit him (an attack of opportunity).
He did have to make a tough concentration check, with the difficulty based on the damage he took.  Using his charisma instead of constitution, since undead have no CON.  Kinda surprised he succeeded, since I don't think his CHA was great when alive...  It depends more on whether he put a lot of points in concentration, though.

He pretty much had to try, though.  Casting defensively just auto-fails against Roy.  (well, he could have floated elsewhere to cast the spell safely, then touched Roy with it in a later round.  But that'd take more time and panels)

Yeah, that's kind of what I was thinking too. This is traditionally about the point where someone comes to the hero's aid, or the hero pulls off a badass or something. Burlew could always buck tradition though.

I'm thinking all the dwarves in the room decide to dogpile Durkula.   Break the agreement and have a death in battle and a chance of saving the world over a minimum 50% chance of serving hel for eternity? Where's my axe?

Oh, that actually might be worth it for them. If they die in battle they don't go to Hel (though it's a bit questionable if breaking an oath like that would make the following battle "dishonorable" on not, though I bet I know which side Thor would take ) so they might consider that a better deal than suffering in Hel for all eternity.

They're actually historically pretty good buddies who often go on adventures together. Although I suppose I can't speak for OotS.
