Prostitution is only legal in one state, that being Nevada.
I'm pretty sure it is legal everywhere if you film it.

I knew about nevada, but wasnt too sure about some others. Nevada's prostitution ordinances are still draconian compared to what our european pal above is used to though. ;)

In Germany they raised the ages for drinking and smoking from 16 to 18 recently. Poor youth.
What? You can still buy beer and wine at 16, I'm pretty sure about that - and theoretically, consumption of alcohol is legal even for toddlers, as long as it doesn't happen in public. And fourteen-year-olds can get wasted on beer in public if their parents are keeping an eye on them.
And now some conservative bigots want to legally require prostitutes to be at least 21.
Wasn't that Seehofer? He's Bavarian, not German :P

Right, only for smoking they raised it to 18. All these regulations and restrictions make me paranoid.  ;D

He's still right. You can't actually just call something pornography instead of prostitution because you filmed it. There are regulations to fufil, employment standards to meet. And it does depend upon the state.

I mean, I assume those things are also true of brothels? Interesting, though, I did not know there were any states where creating pornography was actually entirely banned.

EDIT: I am having a very hard time finding anything other than federal-level rules on the subject. Any tips?

There are no states where the creation or distribution of pornography is banned. Nevada's brothels are heavily regulated.

Then... I'm confused by what you mean by saying that the legality of pornography depends on the state. Because I was pointing out that Max White (probably) was referring to pornography as prostitution with a camera. It sounds like we agree that regulation isn't an issue with the comparison, since they're both regulated where they're legal. I'll preemptively agree that there is a difference in the service being paid for*, but I don't think that there's a meaningful difference in the acts carried out to provide those services (which is what the law should be concerned with anyway).

*Prostitution is payment for a pleasurable sexual act for one of the participants, while pornography is payment for a sexual act that's often not pleasurable for anyone involved (at any rate, pleasure for the participants is irrelevant), since the service is part of creating a product to be marketed.

Yes, but that's true of prostitution as well, so I don't see how it's relevant? I mean, the claim is that it makes no sense for one to be illegal while the other isn't, not that you can turn in a tape to the police to clear your prostitution charges.

EDIT: Prostitution is a heavily regulated industry based on paying people to have sex with other people, with whom they would possibly not ordinarily have sex. Pornography is a heavily regulated industry based on paying people to have sex with other people, with whom they would possibly not ordinarily have sex, and filming them in the process.

Actually, that's not true. As prostitution is only legal in one state, it only has regulations in one state, and thus it does not have varied regulations between states.

Eh, perhaps. I've interpreted his claim to mean what that claim usually means, but of course if he literally meant that filming an act of prostitution makes it suddenly not, then obviously that's absurd. Were that the case, the laws against prostitution would be completely unenforceable, since that's a loophole only slightly smaller than Jupiter. I'll wait for him to clarify - it's clear this argument is a misunderstanding, but on whose part I don't really know.

Also, classifying something as illegal is still a regulation, and that's a hell of a nitpicky argument to be making in the first place since it's heavily regulated where legal, but it still depends on the State (which was your original statement-to-be-taken-literally).
