There's probably a prestige class somewhere that allows them to cast 5th level spells, though (and if there is, it's not called "Cleric").

Hold on there, what if I have +5 wisdom? I would get the ability to cast 5th level spells, but there's none listed. There could be a loophole here.

No. That's like saying a fighter with 13 Intelligence can cast 3rd level spells. Paladins only get up to fourth.

On another note, We could take a Kolaryut. There's six of us, at level 8. That's a level 13 encounter. We are a CR 13 group.

EL =/= ECL
An 8th-level fighter is an EL 8 encounter, but he can't substitute for a whole level 8 party.

Besides, you destroy the first one sent after you, you might just piss of the entire plane of Law enough that they send a whole mess of them after you :P

Imagine a cool peice of sky-blue and milk-white marble about 3cm by 2cm and by 0.5cm, containing a tiny 2mm malacolite crystal. Now imagine the miles of metamorphic rock it's embedded in that no pick or chisel will ever touch. Then, imagine that those miles will melt back into their mantle long before any telescope even refracts an image of their planet. The watchers will be so excited to have that image too.

Two creatures of a certain CR are an ECL of two higher than their CR. Double it again and it raises two more. Add another 50% and it becomes one higher. Thus, CR 13.

If anything, we can take on a CR9 monster. CR 11 or 10 if it's a boss. Encounters are usually made for a party of four with an average level of its CR. So 4 level 8 characters can take on a CR8 monster, 6 (an 50% increase), like us, a CR9 one. We'd need a couple of level ups to have a fair fighting chance.

In addition, such an encounter would be much later, after we clear the catacombs. We'll probably be higher level by then.

...No. We'd be able to beat it, it's just that we'd have a rough go of it. An NPC party of 6 level 8 characters is still a level 13 encounter; in the sense that four level 13 adventurers should need to use about a fifth of their resources to beat them; aka, a pretty easy fight.
