SB 249, if passed, will:

• Create a massive outright ban on firearms in common use that are protected under the
Second Amendment to the United States Constitution.

• Be possibly the largest unconstitutional government taking of private property in California
history, with cost exposure to the state reaching as high as $1 Billion or more, and violating the
Fifth Amendment to the U.S. Constitution.

• Force a government-mandated confiscation & seizure of hundreds of thousands of legallypossessed Bullet Button (maglocked) firearms without compensation for gun owners,
violating the Fifth Amendment to the U.S. Constitution and the California Constitution.

• Make hundreds of thousands of law-abiding Californians, including active law enforcement
officers (who have no exemption under SB 249) into criminals on July 1, 2013.

SB 249 is an
ex post facto law and is expressly prohibited by the U.S. Constitution. SB 249 would criminalize
the possession of firearms that are currently legal to possess. States are prohibited from passing
and enforcing ex post facto laws by Clause 1 of Article I of Section 10 of the U.S. Constitution.

o An ex post facto law (from the Latin for "from after the action" or "after the fact") or
retroactive law is a law that retroactively changes the legal consequences (or status) of
actions committed or relationships that existed prior to the enactment of the law. In
reference to criminal law, it may criminalize actions that were legal when committed
[like SB 249 does].

• Require that California gun owners use ‘featureless’ detachable magazine firearms (which
allows gun owners to legally use lawfully-possessed high capacity magazines in those SB

I'm all for gun control, but if them dot points are representative of the actual reality, they're going about it all wrong.

This is the reason I live in Sweden: no ex post facto laws are suggested or make it through our government. They are too busy complaining about the weather.

Not compensating gun owners is indeed not very nice.
And is it even legal to punish people for things that weren't illegal when they performed the action?

Not according to the US constitution, so the fact that they are trying to (well I assume they are, I didn't read the article and know nothing about the bill). It is a bit puzzling in that the law would get struck down like two days after going to court and get them sued as well.

I'm thinking a mass exodus of people not willing to give up their weapons would happen, moving to a state where this kind of stuff wouldn't be present.

How is it retroactive actually? I mean, it is only illegal to carry the weapons after the bill would pass right?

But other than that and the lack of compensation the only thing I see is pure joy and happiness.

Tried to find unbiased information on this bill instead found nothing but site after site which repeats the exact same buzzwords.

So I'm strongly in favor of this bill.  If your opponents are people who reflexively repeat the same buzzwords then it's probably not because there is an intellectual groundswell of intelligent people opposed to you if you know what I mean.

As near as I can tell, the ONLY thing this gun does make illegal is conversion kits as defined by:

 (1) Any combination of parts that, when affixed to a firearm with
a fixed magazine, are designed and intended to convert that firearm
into an assault weapon as defined by [ previous legislation ]

and

   (2) Any part that, when affixed to a firearm with a fixed
magazine, is designed solely and exclusively to convert that firearm
into an assault weapon as defined by [ previous legislation ]

Saying that this is retroactive is pure rubbish.  It's an assault rifle ban, exactly like any other gun ban.  It's no more "retroactive" than any other gun ban.  But the only people who care about this bill are a tiny, tiny fringe of the gun nuts crowd, because it only affects a tiny tiny fringe of the gun nuts crowd.  These people are used to using extreme hyperbolic language at the drop of a hat.  They'll try to dress it up by lying to you and pretending that millions of people will be affected but it takes about two seconds seconds to think this through:

This is a law that only affects people who own assault weapons in California and modify them to circumvent Californian law.  So in order to be affected you must:
1) Be well aware of California's assault weapons ban
2) Chose to ignore it and risk a fairly substantial penalty

So in summery the hyperbolic nature of the language used here is completely unjustified and the fact that it's repeated so much just shows how reflexive and tribal the NRA crowd has become when the fringe right part of it is unhappy.
