I'll probably be discarding the Shattered Skull Corsairs thing, and figure out a different way for the PCs to come together, or we can think about it in the character creation session.

We definitely have more people than are going to be able to play.  Some might disappear once characters are complete but I'll probably end up picking the five best character concepts.

You can put those in now if you want.  "I want to be an x" doesn't count.

So if you are playing a Chaos Marine are you allowed to be from any of the existing legions? Or are you "Independent" if you understand what I am saying.

Given a starting character's power level, he probably isn't an actual Heresy-era Legionnaire, but you can give him whatever kind of original affiliation you want within reason.  Most of the original Legions are disbanded but some marines still fly the flag, so to speak, even if they weren't there for the Horus Heresy.

So then making a Thousand Sons sorcerer is completely out of the question due to fluff and power level reasons. I may work to something similar then or not. I need to read completely through the Black Crusade book.

Really? Thats awesome. So do you think I can start with a fluffed Thousand Sons sorcerer and then move mechanically to that?

Just curious really. May or may not go for the Thousand Sons, They're just one of my favorite legions.
