DF would probably have to be rated much higher than T. There may not be a lot of graphics, but the game does get descriptive, and you can do and see many horrible things. The RAW files mean that anyone can mod in sex kobolds or butcherable human slaves, and this could end up being DF's Hot Coffee.

Toady is safe from prosecution due to a reason someone already pointed out - Bay12 is a 20K to 30K a year operation. That won't pay an unscrupulous lawyers coke and hooker requirements, let alone fees.

They all want to take down Sony, Microsoft, Rockstar or someone similar. Someone worth millions or billions.

Suppose someone wants to start a new company called Bay 12 Games, or someone enterprising like myself decides that, hmm... Toady One and Bay 12 Games sure have a lot of nerd clout on the internet. Suppose this someone is say... EA who wants to start a new brand to appeal towards this said nerd group instead of being one of the punching bags of the internet.

Now, they have two choices. One, they can offer to buy the company name from the Adams Brothers, which will probably be refused. So, choice number two: Start a new company called Bay 12 games with similar website and launch a lawsuit against the existing one. Obviously they won't win right? But the strategy, as they are well aware of the relative wealth between them, is to bog the Adams Brothers down with so much litigation, so much law expenses, that even though they are innocent, the Adams Brothers will surrender their property.

But, there's no way that will happen. Bay12 doesn't actually have a lot of nerd clout. =|

Well, it's only a name. There's few people that know Dwarf Fortress, but even fewer one that know Bay 12 Games. For a lot of people, "bay12games" only appear in the URL of the forum, they don't say "Oh Dwarf Fortress, that game made by a company called Bay 12 Games", they say "Ah Dwarf Fortress, that game made by a guy named Tarn Adams / Toady One and his brother".

If they were to claim the name "Dwarf Fortress", that will be more annoying. But then again, we could always emphasize on the full name (Slave to Armok 2 : Dwarf Fortress) to show the difference, a bit like OpenOffice.Org.
