Did the aquifer appear when you cycle through the biomes?  There are a few potential problems, and I don't understand which one you're having.

Does the aquifer appear in the embark screen with aquifer set to no in the finder?

Does the aquifer occur during play but the embark screen didn't show it?

Either one would be a problem -- seeds for 40c would be useful here.

If the aquifer occurs just on the very edge of the play map, then the embark screen wouldn't pick up on it, and that wouldn't be a bug precisely, though people might want a warning even in that case.

I've often encountered a site that claims to have an aquifer on the embark screen but there's no actual aquifer once your dwarves are on the ground and digging.

However, being being the lazy bastard that I am, I'm still playing on 39f mostly because I don't want to have to re-import the graphics set I prefer.

I can confirm this bug.

Start up Site Finder with the following parameters:
River: YES
Aquifer: NO

-> You will still sometimes receive sites with aquifers.
